Is prostitution legal in Poland? — Warsaw

Legal — both sides. Poland's model criminalises the surroundings, not the exchange: selling and buying sex between adults is lawful (client-punishment bills have been introduced and rejected), while pimping (Art. 204 §1) and running a brothel (§2) carry up to three years. There are no licensed brothels at all — which is why the visible market is "escort agencies" styled as introduction services, massage studios styled as spas, and apartments with no signage.

What the state actually prosecutes

The enforcement pattern is organisational: the 2022 quasi-brothel bust (four apartments, three premises, ten charged — the flat-rent economics of 170 PLN per worker per day surfacing in court), the central-bureau case of April 2025 (18 arrests across four cities for running a trafficking-flavoured network with 1M PLN in declared income, meetings in rented flats, clients booked by phone operators), and the late-2021 raid on the country's largest ad site (11 arrested, 15,000 monthly ads) — which resurfaced offshore and kept running. Customers appear in none of it.

The client's position is clean on paper and clean in practice: no prosecutions of buyers, no entrapment pattern, the health infrastructure even accommodating the market (free anonymous HIV testing at PKD points, no documents asked; private STI panels at 300–700 PLN; HIV prevalence nationally ~0.1%). The absolute lines are the usual two — 18+, and any involvement with a coerced or trafficked worker, which in the 2025 case's world is the difference between a legal evening and a witness summons.

Legal status — Poland

Legal, brothels illegal. Selling sex is legal and taxable as self-employment, but brothels and any form of procuring are crimes — the sector runs on escort ads and deniable «private flats».

Questions

Does local law apply to tourists?

Yes. The law of the country you are physically in applies regardless of citizenship, and some countries additionally prosecute their citizens for specific offences committed abroad. Ignorance of local law is not a defence anywhere.

What are the penalties in Poland?

Penalties depend on what exactly is prohibited — selling, buying, organising or soliciting — and vary by region and over time. Where buying is criminalised, fines and mandatory courses are typical; where organising is the offence, venues and intermediaries carry the risk. Verify the current law for your specific situation before relying on anything.

How do I check the current situation in Poland?

The general status is described above; for how the law is actually applied, recent changes and city-level specifics — ask.
