Is prostitution legal in Indonesia? — Bali
Illegal — and since January 2026, sharper. Indonesia's new penal code criminalises sex outside marriage: Articles 411/413 make it complaint-based (a spouse, parent or child must file) with up to a year's imprisonment, while promoting "obscene acts" under Articles 420–421 needs no complaint at all. Prostitution itself sits under the morality provisions, the anti-trafficking law (21/2007) adds up to 15 years plus a 600-million-rupiah fine for anyone organising or brokering — and the police can raid venues suspected of supporting prostitution without any family complaint. The consequences foreigners have actually met: arrest, fines, deportation, blacklist.

What the 2026 code changed
Two practical shifts mark the new code. Exposure without a complainant: venue raids now stand on their own — the "family complaint" fiction that limited the old fornication articles no longer shields the commercial layer, and the state has used it (Flame Spa's operators sentenced 2025; three foreign women detained May 2026 after a website raid reached a villa and a hotel). And the broker line: anyone mediating — the fixer, the mami arranging a KTV takeaway, the website operator — sits squarely in the trafficking statute's 15-year band, which converts "just asking around" from a grey habit into a serious charge.
What did not change: Sanur's compounds, untouched by every enforcement wave since the governor's July 2025 vow; the complaint-based core of 411/413 (a private affair between foreigners still needs a family member to file — which is why the tourist prosecutions run through venues, not bedrooms); and the market's shape, which has simply moved further indoors.
The client's honest risk sheet
The paid exchange is illegal on both sides as the law stands, but enforcement plainly weighs on organisers and on visible venues — customers appear in the tally as deported, not prosecuted. The realistic exposures: being inside a raided venue (the code's "supporting prostitution" reach), the blackmail surface a complaint-based law creates (an aggrieved third party can weaponise a private night), and the health-and-scam layer that enforcement attention doesn't protect anyone from. The island's own verdict in what readers report: the scene is worth checking, and the smart money keeps it indoors, sober and out of photographs.

Questions
Does local law apply to tourists?
Yes. The law of the country you are physically in applies regardless of citizenship, and some countries additionally prosecute their citizens for specific offences committed abroad. Ignorance of local law is not a defence anywhere.
What are the penalties in Indonesia?
Penalties depend on what exactly is prohibited — selling, buying, organising or soliciting — and vary by region and over time. Where buying is criminalised, fines and mandatory courses are typical; where organising is the offence, venues and intermediaries carry the risk. Verify the current law for your specific situation before relying on anything.
How do I check the current situation in Indonesia?
