18+ only

Is prostitution legal in Spain?

Short answer: Legal (decriminalized). The details decide — what the law says, how it is enforced, and what that means in practice.

Legal (decriminalized)

18+ only. Informational; legality varies by country.

What the law says

Selling and buying sex between adults is not a crime (decriminalized in 1995); pimping, coercion and trafficking are. There is no national regulatory framework — regional and municipal rules fill the gap. An abolitionist bill that would criminalise clients was postponed indefinitely in 2026 and left out of the government’s legislative plan, so the grey-zone framework stands.

Decriminalized since 1995; pimping and coercion illegal. Regulation varies by region, and a national abolitionist law has been proposed repeatedly without passing. Club-based and flat-rate formats are common.

What it means in practice

No client-side illegality today, but the debate is live and regional rules differ. The classic risks are price disputes and flat-rate club upselling, not the police. Clubs operate as hospitality businesses — watch drink and room charges.

Where it happens

Club-based sector (clubes de alterne) and flat-rate venues outside city centres; street zones largely gone.

Questions

Is prostitution legal in Spain?

Short answer: Legal (decriminalized). Below: what the law says, how it is enforced in practice, and what that means for visitors.

Does “legal” mean safe?

No. Legality and safety are different questions: regulated markets still see scams and robberies, informally tolerated ones carry enforcement risk. Check what travelers report on each city page.

What about enforcement?

Written law and street-level enforcement are not the same thing: raids and local crackdowns come and go. For how the law is actually applied city by city right now, ask.
