Is prostitution legal in Spain? — Madrid

Legal — and unregulated. Sex work between adults is lawful in Spain; the state issues no licences and mandates no checks, while the organising layer is what the law polices: agencies formally sell "introduction services" and payment "for time and company". Madrid added city fines for street prostitution in 2025, and a national reform, up to a ban, has been debated for years without landing.

A legal market, an illegal organisation layer

The frame produces a market of independents: the directories, the classifieds, the apartment incalls (€120–250 an hour) — all lawful commerce between adults. One 2026 note observes that brothels are formally illegal as a formulation, yet the club-and-hotel format (rooms €100–150) operates in that grey: venues sell rooms and drinks, not the work itself. The disputed national numbers size the stakes: about 300,000 workers and €4 billion a year — "Europe’s largest brothel", second in the world after China; a 2008 survey put 32% of Spanish men as having paid, the highest share in Europe. On that scale the state runs no register, no licence and no health frame, and the debate is whether to build one or abolish the market it ignores.

Enforcement as Madrid actually runs it

What the files show is administrative, not criminal, on the client side: the 2025 street fines displaced the Montera/Casa de Campo scene to less visible spots without removing it, and police patrol the Gran Vía strip routinely. Nothing from 2025–2026 shows prosecutions of customers. The state’s sharper instrument targets the advertising layer — the aggregator ban that pushed access to VPN and mirrors — and trafficking enforcement sits with the organised layer, not the street. For a visitor the legal exposure is close to zero; the practical exposure is the unregulated market itself: no floor, no recourse, vetting through closed groups.

Legal status — Spain

Legal (decriminalized). Decriminalized since 1995; pimping and coercion illegal. Regulation varies by region, and a national abolitionist law has been proposed repeatedly without passing. Club-based and flat-rate formats are common.

Questions

Does local law apply to tourists?

Yes. The law of the country you are physically in applies regardless of citizenship, and some countries additionally prosecute their citizens for specific offences committed abroad. Ignorance of local law is not a defence anywhere.

What are the penalties in Spain?

Penalties depend on what exactly is prohibited — selling, buying, organising or soliciting — and vary by region and over time. Where buying is criminalised, fines and mandatory courses are typical; where organising is the offence, venues and intermediaries carry the risk. Verify the current law for your specific situation before relying on anything.

How do I check the current situation in Spain?

The general status is described above; for how the law is actually applied, recent changes and city-level specifics — ask.
